Indian-American investor and entrepreneur Vivek Wadhwa has advocated for the complete abolition of the H-1B visa program, asserting that the system currently causes more harm than benefit to both the United States and India. Having originally entered the U.S. via the H-1B route, Wadhwa acknowledged that the program historically enabled America to emerge as a global leader in technology and innovation, but stated the system has since suffered severe abuse.
In a detailed post on X, Wadhwa outlined how unethical staffing firms—commonly known as “body shops”—learned to exploit the framework, alongside prolonged green-card backlogs that leave skilled immigrants trapped in long-term dependency on employers. He previously informed podcaster Mark Halperin that some H-1B applicants enter the country utilizing fake degrees or inflated resumes facilitated by staffing agencies.
Proposed Reforms and New Framework
System Overhaul: Wadhwa noted that while the second Trump administration implemented stricter measures to obtain H-1B visas, he believes the system is fundamentally broken beyond minor fixes.
Replacement Model: He advocates that Congress scrap the H-1B program entirely and establish a modern skilled-immigration framework targeted at scientists, engineers, researchers, and entrepreneurs.
Startup Visas and Job Creation: Wadhwa strongly endorsed a dedicated startup visa for job-creating entrepreneurs, emphasizing that the framework should prevent labor arbitrage and curb misuse.
Addressing Public Concerns: Rejecting claims that critique of H-1B abuse stems from racism, he stated public frustration targets system exploitation rather than the Indian community.
Dignity for Immigrants: Wadhwa argued that America should continue attracting top global talent while granting skilled immigrants freedom and dignity, rather than subjecting them to decades of immigration uncertainty.
