The United States has introduced strict new visa restrictions targeting individuals and commercial networks that knowingly engage in or facilitate birth tourism to secure U.S. citizenship through childbirth. U.S. Secretary of State Marco Rubio stated that foreign commercial birth tourism networks exploit the U.S. immigration system by coaching foreign nationals to lie on applications and charging tens of thousands of dollars for these arrangements. Implemented under Section 212(a)(3)(C) of the Immigration and Nationality Act, the policy targets network owners, operators, managers, intermediaries, and foreign medical providers who knowingly facilitate birth tourism or fraudulent Medicaid use. Certain family members of those involved may also be covered under these restrictions, which aim to safeguard citizenship value, public benefits, taxpayers, and national security.
Launch of the Public Visa Fraud Reporting Portal:
Separately, the State Department launched a public online portal enabling individuals to submit tips regarding suspected visa fraud and misuse. The reporting portal targets various schemes, including falsified travel plans, broker-arranged sham marriages, shell companies, fabricated job offers, and birth tourism facilitation. The Bureau of Consular Affairs utilizes these public reports for fraud detection and prevention, which can lead to enforcement measures such as visa revocations and law enforcement investigations. The State Department noted that public tips played a significant role in identifying and holding tens of thousands of individuals accountable for visa fraud during President Donald Trump’s second term.
